Texas distracted driving laws at a glance
- Statewide texting ban. It is illegal to read, write, or send an electronic message while driving anywhere in Texas. Violators face fines, and the rule has been in place since September 1, 2017.
- Injury or death enhancement. If electronic messaging while driving causes a crash that results in serious bodily injury or death, the offense can be punished as a Class A misdemeanor.
- School zones and school buses. Drivers may not use a wireless device in a marked school crossing zone, and bus operators may not use a device while transporting minors, with narrow exceptions.
- Drivers under 18. Texas prohibits drivers under 18 from using a wireless communication device while operating a motor vehicle, except in an emergency.
- Local hands-free ordinances. Some Texas cities add stricter rules. For example, some cities are hands-free city that prohibits handheld device use while driving. If your crash happened in another city, local ordinances may also apply.
